1. It is the buyer's obligation to fully grasp the policies of the ESP they have selected (such as Constant Contact, MailChimp, or an internal platform), including any limitations on acceptable bounce rates, misuse rates, and the usage of lists they have paid for. Abuse reports, account bans, and other outcomes from utilising the email list are not Fortune Contacts' responsibility. Purchased lists could be prohibited by some email service providers. ESP recommendations are available upon request. The validity of the emails given will not be affected by any additional internal or outside cleaning, suppressions, or deletions of emails from the list provided. Some third parties or deployment platforms do their own cleaning, which might result in emails being removed from the list or stop the list from being used.

2. Data is offered for sale "as is," with no warranties or assurances. In order to receive payment when a greater bounce rate is detected, the client must communicate to the WHOLE database. Fortune Contacts has the right to ask for information on the email list's use, the items delivered, the bounce list, or any other relevant facts. Additional records will be provided by Fortune Contacts if the bounce rate is higher. (pending bounce list review).

3. Once the order documents are received back and the money has been completed, the normal processing period for list purchases is 36–72 hours. Fortune Contacts will notify the client if processing takes longer than expected. Quantities of data purchased and counts received may fluctuate during the fulfilment process. If supplies are low, Fortune Contacts will get in touch with the customer.

4. Regarding email response, open rates, click through rates, or other indicators of email marketing effectiveness, Fortune Contacts offers no guarantees or promises. Customer hereby releases NDG from any/all liability related to Customer's use of the provided data and Customer's violation of such laws and agrees to comply with all federal, state, and local laws, including but not limited to rules pertaining to the U.S. CAN-SPAM legislation or the Canadian CASL.

Refund of Policy

The same rule applies to databases and email marketing as to software: once accessed or downloaded, a transaction is complete. Due to the sensitive nature of the data, all sales are final and non-refundable. You create a legally enforceable purchase contract by completing your order and supplying your contact information. Our databases have been safeguarded in this way against fraud and data thieves in order to maintain their integrity.*No warranties or assurances are provided with the sale of the data.
